Terms and Conditions
All products offered on this site, both standard and custom, are available at both wholesale and retail cost. All inquiries should be sent via email to customerservice@agapetile.com, or you may call us direct at 910-802-4019.
These Policies and Terms govern both wholesale and retail sales through Agape Tile LLC.
PRICES
Pricing on this website is at or below retail. Additional discounts may be offered to our customers on special order items or large purchases.
The Distributor or Trade cost will be at wholesale cost, listed on the Company’s Price List for the Product. The price of the Product is in U.S. dollars.
All shipping, collection costs, taxes, exchange, license fees, stamps and all charges pertaining to costs associated with product sales are the Buyer’s responsibility. The Company shall have the right, without notice, to change its Price Lists.
QUOTES
All price quotes are valid for fifteen days, excluding shipping.
ORDERS
All wholesale orders must be submitted in writing by Purchase Order via Email or Fax.
The item description, color and quantity must be clearly specified.
For both wholesale and retail call-in phone orders, the Company will send an order confirmation to review for accuracy. The order confirmation must be approved and submitted via Email or Fax before the Company places the order.
Order changes that are submitted after the order confirmation approval may cause delays in shipment and/or additional charges. No order changes will be accepted by the Company without written authorization.
ACCEPTANCE OF ORDERS
While the Company will endeavor to accept all orders submitted, it is expressly agreed that all orders are subject to acceptance by the Company and availability of material.
DIGITAL IMAGES
The company offers no guarantee, exchange or return authorization, that any product received will be an identical match to any photo shown online, or via email, due to variances in the image provided from the manufacturer.
PAYMENT TERMS
Full payment in the form of certified funds, ie. credit card, bank wire or cashier’s/company check, must accompany all orders. Full payment shall include all applicable fees, to include shipping charges. Any additional duties and taxes, applicable state taxes and/or shipping fee charges that are incurred by the Company after time of actual transit is due within 30 days of receipt. Orders placed by the Buyer via Credit Card or Company Check will not be placed with the manufacturer by the Company until clearance of funds with the bank.
All special or custom orders with a manufacturing time of 30 days or less are payment in full. Others: 60% down payment with the balance due upon completion with payment via Bank Wire or Zelle. We do not accept credit cards on wholesale or retail orders over $2500
CANCELLATION OF ORDERS
Cancellation of orders after placement and commencement of manufacturing is not allowed on Special Order items.
FAILURE TO PERFORM
The Company will not be liable for failure to perform if such failure shall be due to fire, labor, material or car shortage, strikes, lock-outs, public enemies, Acts of God or cause beyond the Company’s control.
DISTRIBUTOR SUPPORT
Support services offered to a Distributor by the Company are order placement, order updates, shipping notification, press release distribution, building and contracting project research and referrals and help with sale and after-sale Product questions. The Company will notify the distributor of overstock special pricing on materials, when applicable.
WARRANTY
The Company warrants that the products to be delivered on any order will be the kind designated or specified. The Company does not guarantee results from the use of its products. No warranty, express or implied is given, including, without limitation, warranties of fitness or merchantability with respect to the Company’s Products. As government regulations and use conditions may change it is the customer’s responsibility to determine the appropriate use of these Products for all end users.
Brand Name products are covered by the warranty issued by the manufacturer only. Please refer to their websites to view the warranty of a Brand Name product.
